Twelve ways
things go wrong.
Personal injury is twelve different problems with twelve different rule sets and twelve different ways to lose if you don't move fast. Here's how V+L approaches each.
Motor vehicle accidents.
New Jersey's no-fault rules make MVA cases the most procedural in PI. PIP coordination, the verbal-threshold question, the step-down for uninsured drivers. These decisions get made in the first 30 days, and they shape the entire case.
What V+L does: Pull the police report, audit your PIP, get your medical records in motion, file before the SOL clock takes over. The faster the file is built, the faster the carrier responds.
Truck & commercial vehicle.
Commercial trucks are a different category. Federal motor carrier regulations apply. There are usually multiple defendants: the driver, the employer, the leasing company, the cargo loader. The data lives on a black-box recorder that gets wiped if no one preserves it.
What V+L does: Preserve the ECM data. Identify every responsible party. Read the federal log records. These cases are won in the first two weeks.
Motorcycle accidents.
Bikers get blamed by default. The defense playbook is to argue rider behavior, lane positioning, speed. Anything that shifts the focus off the driver who didn't see you. The injuries are typically more severe, which makes the comparative-fault fight harder.
What V+L does: Build the scene reconstruction early. Lock in witness statements before memories drift. Push back on the bias narrative with documented evidence.
Pedestrian & bicycle.
These cases turn on visibility, signal compliance, and crossing zones. They often involve commercial drivers (delivery, rideshare) whose carriers have deeper pockets but harder-fought defenses.
What V+L does: Identify the right defendant. Pull traffic-cam footage before it's overwritten. Get the cyclist's bike kept as evidence.
Premises liability / slip & fall.
Premises cases live or die on notice. Did the property owner know about the hazard, and did they fail to fix it? "Open and obvious" is the defense's favorite phrase.
What V+L does: Get the incident report before it disappears. Find prior complaints. Document the scene the day of, not weeks later. Notice is provable when you move fast.
Workplace injuries.
Workers' comp is the floor, not the ceiling. If a third party (equipment manufacturer, subcontractor, property owner) contributed to the injury, you have a separate claim outside the comp system.
What V+L does: Coordinate the comp claim and the third-party action so neither undermines the other. Identify all responsible parties early.
Construction accidents.
New Jersey's labor laws and OSHA standards create specific obligations for general contractors and property owners. Falls from height, scaffolding failures, struck-by incidents. Each has its own statutory framework.
What V+L does: Identify every party on the project. File OSHA complaints to lock in the agency's findings. Preserve the equipment and the scene.
Product liability.
Defective products: vehicles, equipment, devices, drugs. The case turns on whether the product was defective in design, in manufacture, or in warning. Multidistrict litigation often runs in parallel.
What V+L does: Keep the product. Identify ongoing recalls and MDLs. Evaluate whether your claim fits a class action or a separate filing.
Wrongful death.
These cases require representation of the estate, separate from a survivor action. New Jersey law caps certain damages and excludes others entirely. The procedure matters as much as the substance.
What V+L does: Open the estate. File both wrongful death and survival actions where appropriate. Move with the dignity these cases require, and the speed your family deserves.
Dog bite injuries.
New Jersey is a strict-liability state for dog bites. The owner's prior knowledge of viciousness doesn't matter the way it does elsewhere. The case is usually about the policy limits on the homeowner's coverage.
What V+L does: File the carrier claim. Document the injury fully. Coordinate with the local animal control report.
Catastrophic injury.
Spinal cord injuries, traumatic brain injuries, amputations, severe burns. These cases have life-care plans and decades of future medical needs. The settlement isn't a number. It's a life plan.
What V+L does: Engage life-care planners and economic experts early. Structure settlements that protect long-term medical, ongoing care, and family financial security. We don't rush these. But we don't waste a day either.
Insurance bad faith.
When a carrier delays, undervalues, or refuses to pay a clear claim, New Jersey law gives the insured a separate cause of action. The bad-faith case sits behind the underlying PI case.
What V+L does: Document every delay, every lowball, every dodged call. The bad-faith case is built in the underlying file.
